Continuing from the front page, we will now highlight some of the new amendments of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA). Again, to go into affect as of October 17, 2005.

The qualification abilities have changed. The bankruptcy attorney will actually administer a “means test” established by the IRS. The “means test” is different for every state. Part of the new “means test” requires that you disclose, or file if you haven’t filed, your most recent tax return, to verify your actual earned income. You have to have below the average income in your state to fail the “means test”. Do you believe the companies know about any of these rules? We can only guess. Consumer products are the products and services which are bought or rented for personal or household use. PROFECO: Mexico’s Consumer Protection Agency

Profeco (Procuraduría Federal del Consumidor) is an administrative branch of Mexico’s federal government whose purpose is to strengthen consumer rights. They have one department that is dedicated to assisting foreigners who have made bad purchases in Mexico or fallen victim to timeshare scam. This department is named C.A.R.E., Departamento de Conciliación a Residentes en el Extranjero. Many timeshare scam victims that have purchased timeshare contracts based on fraudulent promises are referred to Profeco to resolve their disputes against the timeshare developer.

If the timeshare scam victim is trying to cancel within the 5-day rescission period, Profeco will give them a standard cancellation letter to sign, date and send by registered mail to the timeshare developer and [Read more...]

President Obama Signs the Dodd Frank Reform Bill and a New Consumer Protection Agency will be Formed

The “Dodd-Frank” reform bill was recently signed by President Obama. The “Dodd-Frank” reform bill sets up a Federal Consumer Protection agency that oversees credit, credit/debit cards, consumer loans, payday loans and credit reporting agencies. It will regulate fees and lending practices. 

American Financial Institutions will now be required to consider a borrowers income and job status in addition to their credit history. 

This is exciting news because irresponsible lending and borrowing was one large contributor to the US financial crisis. 

It is exciting because we have long advocated for financial reform and government should be playing a larger role to protect Americans but also to educate them.
